By accessing or using Pacey ("the Service"), operated by Pacey ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Pacey is a running plan generator that creates personalized training plans based on your goals, experience, and preferences.
Free Plan: Generates a structured training plan using rule-based algorithms. Includes plan generation, modification, and export capabilities.
Pacey AI Plan (paid upgrade): Provides AI-generated personalized plans through a conversational onboarding process with an AI coach, advanced plan optimization, and ongoing AI-assisted modifications.
3. Account Registration
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account.
4. Payment and Pricing
Pacey offers training plans as a one-time purchase. The current price is displayed on the Service at the time of purchase. All payments are processed securely through Stripe. Once a plan is purchased, you receive lifetime access to that specific plan, including the ability to modify and export it.
We do not offer subscriptions. Each plan is a separate one-time purchase.
5. Refund Policy
Due to the digital nature of the Service, refunds are handled on a case-by-case basis. If you are unsatisfied with your plan, please contact us at [email protected] and we will work with you to find a resolution.
6. User Content and Data Sharing
You retain ownership of any data or content you provide to the Service (e.g., training preferences, personal information). By using the Service, you grant us a limited license to use this data for the purpose of generating and improving your training plan.
Important - Data Sharing on Upgrade: On the free plan, your data is stored securely on our servers and is NOT shared with any third-party AI services. Only when you upgrade to Pacey AI do we share your training preferences (without personally identifiable information) with our AI provider to generate personalized plans. By upgrading to Pacey AI, you consent to this data sharing with our AI provider.
7. AI-Generated Content Disclaimer
Training plans generated by Pacey are created using artificial intelligence and are intended for informational purposes only. They do not constitute medical or professional coaching advice. You should consult with a healthcare professional before beginning any new exercise program. We are not responsible for any injuries or health issues that may arise from following a generated training plan.
8. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Resell or redistribute generated training plans commercially
- Abuse the AI coach with irrelevant or harmful prompts
- Use temporary or disposable email addresses to create accounts
9. Intellectual Property
The Service, including its design, features, and underlying technology, is owned by Pacey and is protected by applicable intellectual property laws. Your purchase grants you a personal, non-transferable license to use your generated training plan.
10. Limitation of Liability
To the maximum extent permitted by law, Pacey shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
